Terms of service

The agreement between you and us for using this site — the account, the tartan designer and the gallery. Using FreeKilt means accepting it. The contest has its own document, and on anything to do with the contest that one wins.

Clause 01

Who runs this site

FreeKilt is run and funded by Scottish Kilt, which supplies every prize from its own catalogue. In these terms “we” and “us” mean Scottish Kilt, and “you” means whoever is using the site.

These terms cover the site. Two other documents sit alongside them and take precedence within their own subject: the contest rules for anything about entering, voting or winning, and privacy and cookies for what happens to your data.

Clause 02

Your account

You need an account to enter a contest, vote, save a tartan or comment. Browsing does not require one.

  • You must be 18 or over to hold an account
  • Give us a real email address — it is how we reach you about an entry or a prize
  • One person, one account. Extra accounts made to vote for yourself will be removed
  • Your login is yours to keep secure, and anything done through it counts as done by you

Tell us straight away if you think someone else has got into your account, and we will help you lock it.

Clause 03

Signing in with Google

You can create your account with an email and password, or with Google. Choosing Google means Google tells us your name, email address and profile picture, and we use them to set up the same account you would otherwise have typed out. We never see your Google password and we ask for nothing else from your Google account.

If the email on your Google account already has a FreeKilt account, the two are the same account — signing in with Google is another door into it, not a second one beside it. You can go on using your password whenever you prefer, and disconnecting FreeKilt from your Google account settings does not delete anything you have entered here.

Clause 04

What you may post

Everything you upload — a photo, a video, a tartan, a comment, a profile picture — has to be yours to upload and fit to be seen by anyone.

  • Nothing unlawful, hateful, harassing, defamatory or sexually explicit
  • No third-party branding, logos or trademarks you have no right to use
  • Nobody else's photograph, video or design passed off as your own
  • People who appear in what you upload have agreed to appear in it
  • No malware, scraping, or attempts to break, overload or reverse-engineer the site
  • No automated accounts, bulk sign-ups or vote scripts

We can take down anything that breaks this, and we do not have to wait for a contest to end to do it. If you think something on the site infringes your rights, write to us through the contact page and we will look at it.

Clause 05

Your content and what we may do with it

You keep the copyright in everything you upload. Always. We do not take ownership of your photograph or your design.

What you give us is a licence to run the site with it: to store it, show it on FreeKilt, and put it in front of the people who are meant to see it. Where an upload is a contest entry, the wider licence — the one that covers advertising use — is clause 7 of the contest rules, and that clause is the one that governs it.

Take something down and the licence for it ends, within 7 days. Two things outlast it: pages recording a past winner, which stay as the public record, and material already printed or already placed in an advertisement, which cannot be recalled from where it has gone.

Clause 06

Tartans you design

A tartan you draw in the designer is yours. You can keep it private, share it, or enter it, and we will not sell or licence it to anyone else.

Traditional tartans are a different matter. The clan and district setts in our library are historic designs that belong to nobody and to everyone — you can weave and share them here, but drawing one does not make it yours, and some are recorded elsewhere with restrictions on commercial use that are yours to check.

If a design of yours is ever to be woven or sold, that is a separate agreement we would put to you in writing first.

Clause 07

Contests, votes and prizes

Entering, voting, how a winner is decided, what the prize is and how it is claimed are all set out in the contest rules. That document is the full agreement for the contest, and where it and this page differ about the contest, it wins.

Prizes come from Scottish Kilt and are made and shipped by Scottish Kilt. A prize is not transferable and there is no cash alternative.

Clause 08

Fair play

Votes are meant to come from people. Buying votes, scripting them, running several accounts, or paying for engagement is not a grey area here — entries found doing it are disqualified and the accounts behind them are closed.

We check votes for duplicates and automation, and the privacy page says what we look at to do it. Where a share has to be verified for a score, the post has to be public long enough for us to see it.

Clause 09

The site itself

We aim to keep FreeKilt up and working, but we do not promise it will never be down. Features change, pages are rebuilt, and parts of the site depend on services we do not control — sign-in providers, email delivery, and the social platforms a share is verified against.

The FreeKilt name, the site design and the software behind it are ours. Your own uploads are excepted, per clause 5.

Clause 10

Suspension and closing your account

You can close your account whenever you like, from your dashboard or by asking us. Closing it withdraws your entries and deletes your data as described in privacy and cookies.

We can suspend or close an account that breaks these terms or the contest rules. Where it is a first mistake and an honest one, we will normally say so and give you the chance to fix it. Where it is vote manipulation or stolen content, we will not.

Clause 11

Liability

Nothing here excludes our liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be excluded. Beyond that, we are not liable for uploads lost in transmission, technical outages affecting entry or voting, anything a third-party service does or fails to do, or indirect loss.

The site is provided as it is. Nothing on it is legal, financial or professional advice.

Clause 12

Changes to these terms

We may amend these terms where we need to. Changes are published here with a new date at the top, and where a change materially affects people who already hold an account, we email them. Carrying on using the site after that is how the new version is accepted; if you would rather not, close the account.

Clause 13

Governing law

Confirm before publishingGoverning jurisdiction — the same one named in clause 15 of the contest rules. Its courts will have exclusive jurisdiction. This does not remove any protection you have under the mandatory consumer law of your own country.
